was the timing of these issues, where the road would land, and there were a cluster of things <br />happening with different agencies that made it difficult. There are things they could have done <br />better as a City to facilitate this more efficiently and accurately. This has been a challeng/ng <br />project, and he asks as a City and staff that they work more diligently and be more open with <br />residents in the future, and allow them the input and the timeframe to make these decisions. <br />Trying to fit in a development as an infill project makes it even more difficult. Mayor Gamec <br />stated at the same time it is up to the Council to make decisions when things get very confusing. <br />When people cannot agree with each other it is time for the Council to step in and make a <br />decision. Staff has worked a lot with this project. Councilmember Cook concurred. He stated <br />they worked back and forth for almost two years on this development. The original opinion was <br />that the City had rights to the road through the maintenance, and they went above and beyond <br />with the residents. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Jeffrey, and <br />Pearson. Voting No: Councilmember Elvig. Absent: Councilmember Strommen. <br /> <br />Further discussion: Councilmernber Jeffrey clarified his concern regarding the developer <br />building a single unit was to be sure they are not put in a box where they cannot put their model <br />up. <br /> <br />Case #6: <br /> <br />Request to Rezone Property from R-1 Single Family Residential to Planned <br />Unit Development; Case of Shadetree Communities <br /> <br />Community Development Director Trudgeon reviewed with Council that on June 14, 2005, <br />Council adopted findings of fact supporting the rezoning of the property proposed to be <br />developed as Shadetree Cottages from R-1 Residential to Planned Unit Development (PUD). <br />The final plat of Shadetree Cottages has just been approved, and it is now appropriate to adopt <br />the zoning ordinance. <br /> . <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Ordinance <br />#06-19 approving the rezoning of the Subject Property fi'om R-1 Residential to Planned Unit <br />Development (PUD) based on Findings of Fact #0721A. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Cook: aye <br />Councilmember Elvig: nay <br />Councilmember Jeffrey: aye <br />Councilmember Olson: aye <br />Councilmember Pearson: aye <br />Councilmember Strommen: absent. <br /> <br />Motion carried. <br /> <br />City Council / June 13, 2006 <br />Page 18 of 26 <br /> <br /> <br />
