of said Lot 3 a distance of 378.06 feet, more or less, to the point of beginning. <br />Together with the right to build, use, and maintain a service road abutting Highway <br />10 over the following described tract: Beginning at the Southeast comer of Lot 3, <br />AUDITORS SUBDIVISION NUMBER 31, thence northwesterly along the North <br />line of said Highway to the Southeast comer of the above described property, <br />thence northwesterly along the easterly line of said property a distance of 40 feet, <br />thence Southeast and parallel with said Highway 10 to the easterly line of said Lot <br />3, thence southerly on said easterly line to point of commencement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on February 7, 1995, and that the public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />2) That the subject site is approximately 30 acres in size. <br /> <br />3) <br /> <br />That a commercial asphalt bituminous plant is not a permitted use in any district in the City <br />of Ramsey. <br /> <br />4) <br /> <br />That the City of Ramsey issued a conditional use permit to the Applicant for an asphalt <br />production plant on January 12, 1988. <br /> <br />5) That the previously issued conditional use permit expired on January 31, 1995. <br /> <br />6) <br /> <br />That on January 20, 1995, the Applicant applied to the City for a new conditional use <br />permit to continue the production of asphalt on the subject property. <br /> <br />7) <br /> <br />That the adjacent properties to the north, south, east and west are zoned either Business <br />Warehouse or Industrial. <br /> <br />8) <br /> <br />That the general vicinity of the proposed facility was zoned Industrial until 1990. The <br />proposed use is compatible with the surrounding industrial uses that developed in the area <br />prior to the rezoning to Business Warehouse in 1990. <br /> <br />9) <br /> <br />That the City has previously issued other conditional use permits for heavy industrial uses <br />in the Business Warehouse District. <br /> <br />lO) <br /> <br />That the asphalt production plant will continue to require silos and conveyers totaling <br />approximately 65 feet in height. <br /> <br />11) <br /> <br />That the Applicant has stated that the plant will continue to process demolition concrete and <br />asphalt into aggregate for re-uSe. <br /> <br />12) <br /> <br />That the use is proposed to continue in operation from approximately April through <br />November of each year and run approximately 14 hours per day, Monday through <br />Saturday. <br /> <br />13) <br /> <br />That the Applicant has been issued a General Air Emission permit for a hot mix asphalt <br />facility #13941-93-G-1 which was issued on April 4, 1993 and expires on January 25, <br />1998. <br /> <br />Resolution #95-02-041 <br />Page 2 of 4 <br /> <br /> <br />
