Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g95-03-053 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PERMANENT <br />DRAINAGE AND UTILITY EASEMENTS BY USE OF MSA {}117.011 AND <br />{}117.042 <br /> <br /> WHEREAS, the City of Ramsey is intending to construct certain drainage improvements <br />in Section 22 known as Improvement Project//95-12; and <br /> <br /> WHEREAS, the Ramsey City Council has ordered Improvement Project g95-12 after <br />conducting a public hearing at its March 14, 1995 meeting; and <br /> <br /> WHEREAS, permanent drainage and utility are required over, under, and across the <br />property where said improvements are proposed to be constructed; and <br /> <br /> WHEREAS, the City has the authority to acquire easements for said improvements by <br />eminent domain pursuant to Minnesota Statutes § 117; and <br /> <br /> WHEREAS, the property owner(s) from whom easements are required have been <br />identified by the City as follows: <br /> <br />PROPERTY <br />IDENTIFICATION <br /> <br /> 22-32-25-23-0002 <br /> <br /> FEE <br /> <br />Stanley E. & Leona E. Welsh <br /> <br /> EASEMENT <br /> DESCRIPTION <br />Parcel 11 of City of Ramsey <br />Easement Plat #1 <br /> <br /> WHEREAS, the City Council finds that it is in the City's best interest that the acquisition <br />of the easements proceed as quickly as possible and, therefore, the City needs to acquire <br />possession of the necessary parcels prior to filing an award by the Court Appointed <br />Commissioners; and <br /> <br /> WHEREAS, the City has the right to acquire easements prior to the filing of an award by <br />the Court Appointed Commissioners, pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the perpetual easements as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey. <br /> <br />2) <br /> <br />That those easements as described above which cannot be acquired by direct negotiation <br />shall be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Council hereby authorizes acquisition of land by eminent domain, and to take <br />title and possession of that land prior to filing of an award by the Court Appointed <br />Commissioners pursuant to Minnesota Statutes § 117.011 and § 1 I7.042. <br /> <br />4) That the City Attorney is authorized to file the necessary petition, therefore, and to <br /> <br />Resolution #95-03-053 <br />Page 1 of 2 <br /> <br /> <br />
