NOTICE OF PUBLIC HEARING <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> TO WHOM IT MAY CONCERN: <br /> Notice is hereby given that the <br /> Ramsey City Council will hold a public <br /> hearing on Tuesday, Ju~e 13, 2006, at <br /> ?:00 p.m., at the R.amsey Fire Station <br /> No. t, 15050 Armstrong Boulevard NW, <br /> Ramsey, Minnesota 55303. <br /> The purpose of the heating is to <br /> consider the following ordinance amend- <br /> lng Sections in Chapter 8 of the City's <br /> Charter. <br /> <br /> ORDINANCE #O~XX <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> AMENDMENTS TO CHAPTER 8 OF <br /> THE HOME RULE CHARTER OF THE CITY <br /> OF RAMSEY. <br /> THE CITY OF RAMSEY ORDAINS. <br /> SECTION 1. AUTHORITY: <br /> This Ordinance is enacted pursuant <br /> to Minnesota Statutes §410.12, Subd. 7. <br /> S[CTION 2. AMENDMENT. <br />r <br /> Subsections 8.4.2, 8.4.3 and 8.4.4 <br /> of the Home Rule Charter of the City of <br />; Rarnsey are hereby amended to provide <br />· as written below: CHAPTER 8 <br /> PUBLIC IMPROVEMENTS AND <br /> SPECIAL ASSESSMENTS <br /> 8.4.2 Petition Against the Local <br /> Improvement. A proposed local improve- <br /> ment may be initiated by petition of the <br /> owners of real property abutting on the <br /> streets named in the petition. If, within <br /> thirty (30) days of the conclusion of the <br /> public hearing, a petition against such <br /> local improvement is filed with the city <br /> administrator which petition is signed <br /> by a percentage of the owners of real <br /> property abutting on the streets named <br /> in the initiating petition as the location <br /> of the improvement which percentage <br /> is greater than the percentage of owners <br /> of real property who signed the initiating <br /> petition, the council shall not make such <br /> local improvement at the expense of the <br /> abutting proper~ owners. For purposes <br /> of the foregoing sentence, "owners of <br /> real properS" shall not include owners <br /> of properties zoned for commercial or <br /> industrial uses or owners of properties <br /> zoned residential greater than 10 acres <br /> in size based on zoning classifications <br /> in effect at the date of such petition, or <br /> owners of non-homestead real proper~y <br /> greater than one acre in size. <br /> 8.4.3 Counter Petition in Favor of <br /> the Improvement. If within thirty (30) <br /> days of the filing with the city admin- <br /> istrator of a petition against the local <br /> improvement as described in Section <br /> 8.4.2 above, there is filed with the city <br /> administrator a petition in favor of the <br /> local improvement, signed by owners <br /> of real property abutting on the streets <br /> named in the initiating petition as the <br /> location of the improvement, in a per- <br /> centage greater than the percent of own- <br /> ers of real property who signed the <br /> petition against the local improvement, <br /> then in such event the council may <br /> disregard the petition against the local <br /> improvement and proceed with the local <br /> improvement· <br /> 8.4.4 Petition Against Council <br /> Initiated Improvement. If the local <br /> improvement was initiated by council res- <br /> olution without an initiating petition and, <br /> within sixty (60) days of the conclusion <br /> of the public hearing, a petition is filed <br /> with the city administrator against such <br /> local improvement and which petition is <br /> signed by greater than 50 percent of the <br /> owners of real property proposed to be <br /> assessed for and benefited by the local <br /> improvement, the council shall not make <br /> such local improvement at the expense of <br /> the benefited property owners. For pur- <br /> poses of the foregoing sentence, "owners <br /> of real properb/' shall not include owners <br /> of properties zoned for commercial or <br /> industrial uses or owners of properties <br /> zoned residential greater than 10 acres <br /> in size based on zoning classifications <br /> in effect at the date of such petition, or <br /> owners of non-homestead real property <br /> greater than one acre in size· <br /> SECTION 3. EFFECTIVE DATE. <br /> This Ordinance shall become effective <br /> 90 days after its passage and publication <br /> subject to the provisions of Minnesota <br /> Statutes §410.12, Subd. 7. <br /> All interested persons are invited to <br /> attend the hearing and comment on the <br /> I~roposed Cfiarter amendment. Th~ City <br /> of Ramsey complies with the Americans <br /> with Disabilities Act and, upon advance <br /> request, information will be provided <br /> in an alternative form and interpreters <br /> will be available.
