Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-06-137 <br /> <br />RESOLUTION APPROVING AN <br />FOR THE LOWER RUM <br />ORGANIZATION <br /> <br />AMENDED JOINT POWERS AGREEMENT <br />RIVER WATERSHED MANAGEMENT <br /> <br /> WHEREAS, Minnesota Laws of 1982, Chapter 509, requires all metropolitan <br />watersheds to organize, either as a joint powers group or as a watershed district; and <br /> <br /> WHEREAS, the four cities with lands in the Lower Rum River watershed adopted a <br />Joint Powers Agreement in 1985, creating the Lower Rum River Watershed Management <br />Organization, and the four cities have worked cooperatively since said time to manage surface and <br />groundwater concerns in the watershed; and <br /> <br /> WHEREAS, the Minnesota legislature has, over the years, adopted many new laws <br />mandating the Organization to perform additional duties and to be responsible for public concerns <br />relating to surface and groundwater, and in 1990 adopted major changes in legislation known as <br />the "Metropolitan Surface Water Management Act", renumbered State Statutes, and directed the <br />Board of Water and Soil Resources to promulgate new rules regarding water management <br />organizations; and <br /> <br /> WHEREAS, the new State Rules became effective August 1, 1992, and directed all joint <br />powers water management organizations to amend their joint powers agreements to be consistent <br />with the new State Laws and Board of Water and Soil Resources rules; and <br /> <br /> WHEREAS, the Lower Rum River Watershed Management Organization has prepared a <br />revised joint powers agreement to comply with state mandates and state law, and the Organization <br />has reviewed and recommended that each member City approve the new Joint Powers Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Mayor and City Administrator are hereby authorized and directed to execute the <br />attached Amended Joint Powers Agreement which will continue the Lower Rum River Watershed <br />Management organization with powers and duties as expressed therein and consistent with State <br />Statutes and rules of the Board of Water and Soil Resources. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Hardin <br />Councilmember Beyer <br />Couneilmember Zimmerman <br />Couneilmem~r Beahen <br />Couneilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br /> <br />
