15. The maximum noise level at the perimeter of the worksite shall be within the limits set by the Minnesota Pollution Control Agency and the Environmental Protection Agency of the United States. 16. All costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the grading operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. 17. All grading operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. 18 The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. 19. All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. The motion for adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Kenneth Peterson Councilmember Sheila Beyer Councilmember Gerald Zimmerman Councilmember Carolyn Beahen and the following voted 'against the same None and the following abstained None and the following were absent Mayor Glen Hardin whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the 1 lth day of July, 1995.
