Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-07-150 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0381 RELATING TO A <br />REQUEST FOR A VARIANCE FROM STREET FRONTAGE OR LOT WIDTH <br /> REQUIREMENTS <br /> <br /> WHEREAS, Joel and JoDee Nelson, hereinafter referred to as "Applicants", have <br />properly applied for a Board of Adjustment variance from the minimum lot width requirement <br />established in Section 9.20.11 of the Ramsey City Code in order to construct a dwelling on the <br />following legally described property: <br /> <br />The east half of the Northwest Quarter of the Northwest Quarter of Section 7, Township <br />32, Range 25, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on July 20, 1995 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the Subject Property is zoned R-1 Rural Residential and is approximately 20 acres in <br />size. <br /> <br />3. That the Subject Property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.11.01 of the Ramsey City Code states that no lot shall contain any building <br />used as a dwelling unless it has the minimum lot width; Section 9.20.11 states that the <br />minimum lot width in the Rural Residential District is 200 feet; Section 9.02 states that in <br />no case shall street frontages in the Rural area be less than 200 feet. <br /> <br />5. That the Subject Property has approximately 33 feet of frontage on a public road. <br /> <br />6. That the City has previously granted similar variances. <br /> <br />7. That the variance requested is thc minimum variance which would alleviate the hardship. <br /> <br />That in its current state, the only means for City maintenance vehicles to turn around after <br />plowing the western terminus of 173rd is to mm around in private driveways accessing <br />onto 173rd Avenue N.W. <br /> <br />That the City is currently amending its transportation plan and it will include the extension <br />of 173rd Avenue N.W. west to the common boundary with Elk River. <br /> <br />10. <br /> <br />That the special conditions, 33 feet of frontage on a public road, do not result from the <br />actions of the Applicant. <br /> <br />11. <br /> <br />That the granting of the variance will not grant the Applicant any special privileges that are <br />denied by this Chapter to other owners of land in the same district. <br /> <br />12. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of this <br />Chapter or other property in the same zone. <br /> <br /> <br />
