Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 95-08-168 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF <br />PERMIT BASED ON FINDINGS OF FACT 6'0383 AND <br />PERMIT TO GRADE AND EXPORT SOILS <br /> <br />A CONDITIONAL USE <br />DECLARING TERMS OF <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 95-08-167 adopting Findings <br />of Fact g0383 for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On August 8, 1995, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to <br />Good Value Homes, Inc. ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br />Outlot A, Chesmut Ridge, Anoka County, Minnesota. <br /> <br />That part of the Northwest Quarter of the Northeast Quarter of Section 26 Township 32, <br />Range 25, Anoka County, Minnesota, lying south of County Ditch g43. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire on December 1, 1995 and the Permit Holder shall be responsible for <br />providing the City with at least 48 hours advance notice of the date of commencement of <br />operations. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated August 1, <br />1994 prepared by Passe Engineering, Inc. The proposed area to be graded is roughly sixty- <br />five (65) acres in size. Excavation of the entire area shall be permitted. Continuation of <br />grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and <br />disc anchored mulch. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in such <br />a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed <br />from the worksite regularly. <br /> <br />Thc haul route, ingress and egress, shall be as follows: south on Potassium Street N.W, west <br />on 145th Lane N.W., and continuing west on Sunfish Lake Drive to Sunfish Lake Blvd. <br /> <br />All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br /> <br />6. Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br /> <br />
