17. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred <br />Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to <br />reimburse the City for expenses incurred in the administration of this permit. At the time the <br />mining operation and site restoration are completed to the satisfaction of the City, the balance of <br />the escrow shall be returned to the Permit Holder. <br /> <br />18. <br /> <br />All grading operations shall be conducted between 7:00 a.m. and 8 p.m. on weekdays only <br />unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />19. <br /> <br />Thc mount of dust or other particulate matter caused by thc mining operation shall not exceed <br />the standards established by the Minnesota Pollution Control Agency. No operation shall be <br />allowed when wind gust exceed 30 miles per hour. <br /> <br />20. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency regulations <br />and Federal and Environmental Protection Agency regulations for the protection of water <br />quality. <br /> <br />21. <br /> <br />All haul roads are subject to the approval of the City Engineer. While hauling operations are in <br />progress, the permit holder shall maintain the haul road in a condition satisfactory to the City <br />Engineer. When hauling operations are completed, the permit holder shall either restore that <br />haul road to a condition at least equal to that which existed at the time the hauling operations <br />were started, or compensate the local road authority in an amount satisfactory to that road <br />authority and concurred in by the City Engineer for the restoration of that haul road. The City <br />Engineer will then accept such restoration or concur in such f'mancial settlement for the <br />restoration of the haul road in writing and such acceptance will relieve the permit holder of any <br />additional obligation in connection with the restoration of the haul roads. If the permit holder <br />fails or refuses to perform haul road restoration or to make satisfactory f'mancial settlement for <br />such restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember Beyer and <br />upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Glen Hardin <br />Councilmember Kenneth Peterson <br />Councilmember Gerald Zimmerman <br />Councilmember Sheila Beyer <br />Councilmember Carollyn Beahen <br /> <br />and the following voted against the same <br /> <br />None <br /> <br />and the following abstained <br /> <br />None <br /> <br />and the following were absent <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the <br />8th day of August, 1995. <br /> <br /> <br />
