Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #95-08-170 RESOLTUION AUTHORIZING ACQUISITION OF PROPERTY FOR SANITARY SEWER PURPOSES WHEREAS, the City has initiated its public improvement project //95-13 (the "Improvement Project") which project consists of constructing sanitary sewer trunk lines for the purpose of serving various properties in the City with municipal sewer service; and WHEREAS, fee title to certain real property is required to provide for the construction of the Improvement Project and in order to further the public health, safety and convenience of the residents of the City; and WHEREAS, the City has authority to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed Commissioners, pursuant to Minn. Stats. § 117.011 and § 117.042; and WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: PIN FEE OWNER 23-32-25-34-0006 Thomas R. Kurak REAL PROPERTY DESCRIPTION All that part of the following described property; The Southeast Quarter of the Southwest Quarter of Section 23, Township 32, Range 25, Anoka County, Minnesota lying east of a line 70.00 feet, as measured at right angles, southwesterly, westerly, and southwesterly of a line described as follows: Commencing at a point on the North line of the Northwest Quarter of the Northeast Quarter of Section 26, said Township 32, Range 25, a distance of 577.04 feet east of the Northwest corner of said Northeast Quarter of Section 26, thence North 3 degrees 57 minutes 01 seconds west for a distance of 10.01 feet; thence north 54 degrees 24 minutes 53 seconds west for a distance of 700.00 feet; thence north 2 degrees 48 minutes 34 seconds west for a distance of 700.00 feet; thence north 71 degrees 00 minutes 52 seconds west for a distance of 565.38 feet; thence north 59 degrees 05 minutes 54 seconds west for a distance of 241.52 feet; thence north 18 degrees 16 minutes 43 seconds west for a distance of 354.25 feet and there terminating. For the purpose of this description the North line of said Northeast Quarter of Section 26 is assumed to bear south 88 degrees 43 minutes 43 seconds west.
