Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION #95-09-207 <br /> <br /> A RESOLUTION APPROVING THE ISSUANCE OF A TEMPORARY <br />DWELLING MOVING PERMIT AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, George Grabrick and American Family Insurance have properly applied for <br />a Dwelling Moving Permit for the temporary placement of a mobile home on the property generally <br />known as 7731 172nd Lane N.W. and legally described as follows: <br /> <br />Lot 2, Block 1, Golden Eagle Estates, Anoka County, Minnesota <br />(Subject Property); and' <br /> <br /> WHEREAS, the Planning Commission met on September 11, 1995, to review the <br />application and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />A Dwelling Moving Permit, hereinafter referred to as "Permit", is hereby granted to George <br />Grabrick and American Family Insurance, hereinafter referred to as "Permittee", for the <br />temporary placement of a mobile home, hereinafter referred to as "Temporary Structure", <br />on the Subject Property. <br /> <br />2. That the Permittee shall provide the City with proof of ownership of the Subject Property. <br /> <br />3. That this Permit shah expire on April 30, 1996. <br /> <br />That the placement of the Temporary Structure shall comply with all applicable codes and <br />prior to taking occupancy, the Permittee shall arrange for a City inspection of the sewer and <br />water service connections. <br /> <br />That the Permittee shall be responsible for providing the City with proof that the transporter <br />of the Structure is licensed to operate in the State of Minnesota and all necessary permits <br />have been obtained. <br /> <br />That the temporary sewer and water connections shall be removed and the property shall be <br />restored to its original condition prior to the fire. <br /> <br />That the Permittee shall provide the City of Ramsey with a financial guarantee in the form <br />of cash or a letter of credit, approved as to form by the City, in the amount of Five <br />Hundred Dollars and no cents ($500.00) for the purpose of guaranteeing compliance with <br />the terms of this Permit and timely removal of the Temporary Structure. <br /> <br />Upon verification that the Temporary Structure has been removed from the Subject <br />Property, the financial guarantee shall be returned to the Permittee. In the event the <br />Permittee fails to comply, the City may complete perform any remedial action necessary <br />with City day labor and/or by letting contracts for said remedial action and draw upon the <br />escrow for payment. The Permittee hereby grants permission and a license to the City <br />and/or its contractors and assigns to enter upon the Subject Property for the purpose of <br />performing remedial action in the event of the Permittee's default. <br />That in the event the project completion is not feasible by the April 30, 1996 expiration <br />date, the Permittee shall apply to the City Council for an extension of the Permit prior to the <br />the Council's first regular meeting in March of 1996. <br /> <br />That the Permittee hereby agrees to reimburse the City for all expenses incurred in <br />administering and enforcing this Permit. Failure to pay the City expenses incurred within <br />15 days of billing by the City shall also permit the City to draw upon the financial guarantee <br />required by this Permit. <br /> <br /> <br />
