Councilmember Zimmerman inu:oduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION /t95-09-208 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0386 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br />ON THE PROPERTY GENERALLY KNOWN AS 8131 154TH LANE N.W. <br /> <br /> WHEREAS, Gary and Susan Maxson, hereinafter referred to as "Applicants", have <br />properly ap~plied for a Conditional Use Permit for a Home Occupation to establish and operate a <br />dog groonung service on the property generally known as 8131 154th Lane N.W. and legally <br />described as follows: <br /> <br />Lot 3, Block 14, WHISPERING PINES ESTATES, Anoka County, Minnesota. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home Occupations) of <br />the Ramsey City Code on September 5, 1995 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 1 acre in <br />size. <br /> <br />3. That professional services are not a permitted use in the R-1 Rural Residential District. <br /> <br />4. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That the Applicant has provided documentation to support that the home occupation will be <br />conducted within the private dwelling on the property and that the area set aside for the <br />home occupation (172 square fee0 does not exceed 20% of the total floor area of the private <br />dwelling (1,623 square feet). <br /> <br />6. That the Applicant will reside at the location of the proposed home occupation. <br /> <br />That the Applicant has stated that the home occupation will not include any employment of <br />persons not residing in the private dwelling in the performance of the home occupation. <br /> <br />That the Applicant has stated that there will be no exterior storage of business equipment <br />and materials. <br /> <br />That the Applicant has stated that all animals will be held in kennels within the private <br />dwelling during the grooming service and until they are picked up by the owners. <br /> <br />10. <br /> <br />That the Applicant has stated that the business will be limited to 4 animals a day, three days <br />a week. <br /> <br />11. <br /> <br />That the proposed use will/will not substantially increase traffic to and from the subject <br />property. <br /> <br />12. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to <br />neighboring residences. <br /> <br /> <br />
