~ouncilmember Beyer introduced the following resolution and moved for its adoption: <br /> PROPOSED RESOLUTION #95-09-209 <br /> <br /> A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT FOR A HOME OCCUPATION AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Gary and Susan Maxson have properly applied for a conditional use permit <br />for a home occupation to establish and operate a dog grooming service within the private dwelling <br />on the property generally known as 8131 154th Lane N.W. and legally described as follows: <br /> <br />Lot 3, Block 14, WHISPERING PINES ESTATES, Anoka County, Minnesota (Subject <br />Property); and <br /> <br /> WHEREAS, the Planning Commission met on September 5, 1995, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact g0386, a conditional use permit for a home occupation is hereby <br />granted to Gary and Susan Maxson, hereinafter referred to as "Permit Holder", at 8131 <br />154th Lane N.W. for a pet grooming business. <br /> <br />Should the Permit Holder die or move to a new location, the permit shall be automatically <br />terminated, except that in the case of death, should a surviving spouse or child, residing at <br />the same address, desire to continue the home occupation, written notice to that effect shall <br />be given to the City Administrator and the City Council may authorize continuation of the <br />permit without further hearing. <br /> <br />That business hours shall be from 9:00 a.m. to 5:00 p.m., five (5) days a week. <br />That the number of animals groomed per week shall not exceed twenty (20). <br /> <br />The area devoted to the home occupation shall not exceed twenty percent (20%) of the total <br />floor area of the private dwelling. <br /> <br />Adequate water supply and on-site sewage disposal facilities shah be the responsibility of <br />the Permit Holder. <br /> <br />7. Adequate off-street parking shall be provided by the Permit Holder. <br /> <br />Them shall be no display of business signs or any exterior indications of the home <br />occupation within. <br /> <br />There shall be no exterior storage of business equipment and materials and all animals <br />delivered to the property shall be held within the private dwelling until they are retrieved by <br />their owners. <br /> <br />10. <br /> <br />Employees of the home occupation shall be restricted to persons residing within the private <br />dwelling on the Subject Property. <br /> <br />11. <br /> <br />Merchandise shall not be displayed or offered for sale either within or outside of the <br />residence. <br /> <br />12. <br /> <br />That the Permit Holder shall be responsible for any costs incurred by the City in <br />administering and enforcing this permit. <br /> <br /> <br />
