~ouncilmember Beyer introduced the following resolution and moved for its adoption: PROPOSED RESOLUTION #95-09-209 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION AND DECLARING TERMS OF SAME WHEREAS, Gary and Susan Maxson have properly applied for a conditional use permit for a home occupation to establish and operate a dog grooming service within the private dwelling on the property generally known as 8131 154th Lane N.W. and legally described as follows: Lot 3, Block 14, WHISPERING PINES ESTATES, Anoka County, Minnesota (Subject Property); and WHEREAS, the Planning Commission met on September 5, 1995, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact g0386, a conditional use permit for a home occupation is hereby granted to Gary and Susan Maxson, hereinafter referred to as "Permit Holder", at 8131 154th Lane N.W. for a pet grooming business. Should the Permit Holder die or move to a new location, the permit shall be automatically terminated, except that in the case of death, should a surviving spouse or child, residing at the same address, desire to continue the home occupation, written notice to that effect shall be given to the City Administrator and the City Council may authorize continuation of the permit without further hearing. That business hours shall be from 9:00 a.m. to 5:00 p.m., five (5) days a week. That the number of animals groomed per week shall not exceed twenty (20). The area devoted to the home occupation shall not exceed twenty percent (20%) of the total floor area of the private dwelling. Adequate water supply and on-site sewage disposal facilities shah be the responsibility of the Permit Holder. 7. Adequate off-street parking shall be provided by the Permit Holder. Them shall be no display of business signs or any exterior indications of the home occupation within. There shall be no exterior storage of business equipment and materials and all animals delivered to the property shall be held within the private dwelling until they are retrieved by their owners. 10. Employees of the home occupation shall be restricted to persons residing within the private dwelling on the Subject Property. 11. Merchandise shall not be displayed or offered for sale either within or outside of the residence. 12. That the Permit Holder shall be responsible for any costs incurred by the City in administering and enforcing this permit.
