<br />Please Note – this resolution is missing – below is a draft resolution with information from the <br />meeting minutes . . . <br /> <br />Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-09-211 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE <br />PURPOSES SUBJECT TO THE CITY ATTORNEY’S REVIEW OF THE LEGAL <br />DESCRIPTION <br /> <br />Case #11: Property Acquisition <br /> <br />City Engineer Sankowski stated that last March, the City Council authorized Improvement <br />Project g95-12 which involved drainage improvement to an area located in Section #22. In May, <br />all drainage improvements outlined in the project feasibility study were performed, with the <br />exception of the installation of two culverts at each end of a pond located on the <br /> <br />Lewis property. Mr. Lewis indicated that the swans he raises in the pond were nesting and could <br />not be disturbed until after the cygnets hatched in June. Mr. Jankowski reported that he had been <br />leaving messages on Mr. Lewis' answering machine since mid-June and had not heard anything <br />back from him, until tonight. Mr. Lewis, who has been out of town, has indicated that he <br />obtained the culverts and that he would install them himself. Mr. Jankowski anticipated Mr. <br />Lewis' cooperation but stated he does not have a problem asking for the adoption of the <br />resolution to begin eminent domain proceedings anyway. <br /> <br />Councilmember Beyer stated she thought Council had already adopted a resolution initiating <br />eminent domain proceedings for this project. <br /> <br />Mr. Jankowski explained that Council adopted a resolution authorizing acquisition of easements, <br />not a condemnation resolution. <br /> <br />Councilmember Beyer inquired about not having the easements but commented that the <br />work is done. <br /> <br />Mr. Jankowski replied that was correct because we were given permission to enter onto the <br />property. He stated that several property owners did have concerns about granting easements and <br />he is not certain all will do so. <br /> <br />Discussion ensued about condemnation proceedings and Council directed that Staff should <br />present resolutions pertaining to the remainder of the properties. <br /> <br />Councilmember Beyer commented she would rather acquisitions were done through negotiations <br />instead of through condemnation proceedings. <br /> <br />Resolution #95-09-211 <br />Page 2 of 2 <br /> <br />
