Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #95-09-233 RESOLUTION APPROVING PARTIAL PAYMENT TO H & M ASPHALT FOR IMPROVEMENT PROJECT 095-15 (CONSTRUCTION OF SANITARY SEWER, WATERMAIN, STORM SEWER AND STREETS TO SERVICE FOX KNOLL) WHEREAS, the City Council of the City of Ramsey approved this project on June 27, 1995; and WItEREAS, the City Council of the City of Ramsey adopted a resolution awarding the bid to H & M Asphalt. for the construction of sanitary sewer and watermain, storm sewer and streets to service Fox Knoll (Improvement Project #95-15); and WHEREAS, City Engineer Steve Jankowski has inspected and recommends partial payment to H & M Asphalt in the mount of $64,436.12. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to H & M Asphalt for the construction of sanitary sewer and watermain, storm sewer and streets to service Fox Knoll (Improvement Project g95-15) in the amount of $64,436.12. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of September, 1995. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beahen and upon vote being taken thereon, the following voted in favor thereof: Mayor Hardin Councilmember Peterson Coundlmember Beahen Councilmember Beyer Councilmember Zimmerman and the following voted against the same: None and the following abstained: None and the following were absent: None
