Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION g95-10-238 RESOLUTION APPROVING PARTIAL PAYMENT TO W.B. FOR IMPROVEMENT PROJECT g95-11 (CONSTRUCTION BUSINESS PARK 95 PUBLIC IMPROVEMENTS) MILLER, INC. OF RAMSEY WHEREAS, the City Council of the City of Ramsey approved this project on March 28, 1995; and WHEREAS, on May 9, 1995, the City Council of the City of Ramsey adopted Resolution g05-05-098 awarding the bid to W.B. Miller, Inc. for the construction of Improvement Project g95-11; and WHEREAS, previous payments have been made for Improvement Project g95-11 to W.B. Miller, Inc. in the amount of $237,611.86. WHEREAS, the City Engineer has inspected the completed work and recommends partial payment to W.B. Miller, Inc. in the amount of $53,921.26. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to W.B. Miller, Inc. for the construction of Improvement Project g95-11 in the amount of $53,921.26. 2) That the City Council hereby authorizes the Mayor or City Administrator to sign the release form for this partial payment. 3) That the total amount of this partial payment is not included in resolutions approving payment of bills for the month of October 1995. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman upon vote being taken thereon, the following voted in favor thereof: Mayor Hardin Councilmember Beahen Councilmember Zimmerman Councilmember Peterson and the following voted against the same: None and the following abstained: None and the following were absent: Councilmember Beyer
