Counciimember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g95-11-253 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR <br />DRAINAGE PURPOSES <br /> <br /> WHEREAS, the City has initiated its public Improvement Project g95-12 (the <br />"Improvement Project") which project consists of constructing drainage improvements in a <br />portion of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 <br />and part of the Southeast Quarter of the Southwest Quarter, Section 15, Township 32, <br />Range 25, Anoka County, Minnesota; and <br /> <br /> WHEREAS, a perpetual drainage easement over, under and across certain real <br />property are required to provide for the construction of the Improvement Project and in <br />order to further the public health, safety and convenience of the residents of the City; and <br /> <br /> WHEREAS, the City has authority to acquire the easements for the Public <br />Improvement by eminent domain pursuant to Minnesota Statutes Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the easements prior to the filing of <br />an award by the Court appointed commissioners, pursuant to Minnesota Statutes §117.011 <br />and § 117.042; and <br /> <br /> WHEREAS, certain of the property owners of the parcels of real property which <br />are affected by the easements to be acquired have been identified in a City Resolution g95- <br />09-2! 1; and <br /> <br /> WHEREAS, the City has identified parcels and property in addition to those <br />identified in Resolution g95-09-211 which additional parcels and property are necessary to <br />acquire in order to construct the project; and <br /> <br /> WHEREAS, the additional parcels and additional property have been identified <br />as follows: <br /> <br />FEE OWNER <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />Robert J.
