Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION #95-11-259 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT <br />FOR A TEMPORARY STRUCTURE AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Amcor Precast, tradename of Oldcasfle Precast, Inc. has properly applied <br />for an interim use permit for a temporary structure for the purposes of providing additional office <br />space on the property generally known as 6640 Industry Avenue N.W. and legally described as <br />follows: <br /> <br />The East Half of the Southeast Quarter of the Southwest Quarter of Section 27, Township <br />32, Range 25, Anoka County, Minnesota, except that part thereof described as follows: <br /> <br />Commencing at the Northwest comer of said East Half of the Southeast Quarter of the <br />Southwest Quarter; thence South along the West line of the said East Half of the Southeast <br />Quarter of the Southwest Quarter 409.44 feet to the point of beginning; thence East at right <br />angles 11 feet; thence South at right angles 264 feet; thence West at right angles to the West <br />line of said East Half of the Southeast Quarter of the Southwest Quarter; thence North <br />along said West line to the point of beginning. <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on November 9, 1995, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact ~K)388, an interim use permit for a temporary structure is hereby <br />granted to Amcor Precast, hereinafter referred to as "Permit Holder", at 6640 Industry <br />Avenue N.W. <br /> <br />2. This permit shall terminate on June 30, 1997. <br /> <br />The size, type of construction and placement of the temporary structure shall be in <br />accordance with the one (1) sheet site plan attached hereto as Exhibit A. <br /> <br />The temporary structure shall comply with all applicable Building Code and Fire Code <br />regulations and standards for such structures. The Permit Holder shall be responsible for <br />obtaining all necessary permits, including a building permit, prior to moving the structure <br />onto the property. Said building permit will not be issued until all financial obligations <br />relating to this permit and the application escrow account have been satisfied. <br /> <br />The Permit holder shall be responsible for all City costs incurred in administering and <br />enforcing this interim use permit. Said expenses shall be paid within 15 days of billing by <br />the City and failure to pay the City's expenses within the 15 day billing period will permit <br />the City to draw upon any of the escrows required by this agreement for payment. <br />Furthermore, to ensure the timely removal of the temporary structure prior to the expiration <br />date of this permit, the Permit Holder shall maintain a minimum balance of $500.00 in the <br />application escrow account until such time as the permit has expired and/or the temporary <br />structure has been removed from the property. <br /> <br /> <br />
