15. <br /> <br />The operator of the facility will provide a visual inspection of all trucks and remove any <br />debris from them prior to the tracks leaving the site, and take precautions to prevent <br />spillage from tracks. <br /> <br />16. <br /> <br />The City may initiate action to revoke the conditional use permit in accordance with <br />procedures established in the Ramsey City Code. <br /> <br />17. <br /> <br />The failure of the City at any time to require performance by the permittee of any provisions <br />hereof shall in no way affect the right of the City thereafter to enforce the same. Nor shall <br />waiver by the City of any breach of any of the provisions hereof be taken or held to be a <br />waiver of any succeeding breach of such provision or as a waiver of any provision itself. <br /> <br />18. <br /> <br />If any provision of this CUP shall be declared void or unenforceable, the other provisions <br />shall not be affected, but shall remain in full force and effect. <br /> <br />19. <br /> <br />The Permittee agrees to connect to City sewer and water at the time sewer and water is <br />extended to the area and herein agrees to join in a petition for such improvements provided <br />such petition is not presented within 7 years of the City's acceptance of the required <br />improvements to 143rd Avenue N.W. and Jaspar Street N.W. However, the Permittee <br />does not relinquish their rights under Minnesota Statutes Chapter 429, or Ramsey City <br />Code Chapter 4, to appeal the amount of the assessments. <br /> <br />20. <br /> <br />The City Administrator, or his/her designee, shall have the right to inspect the premises for <br />compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />21. <br /> <br />The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this conditional use permit. Said expenses shall be paid within fifteen (15) days of billing <br />by the City and failure to pay the City's expenses within the fifteen (15) day billing period <br />will permit the City to drawn upon any of the escrows required by this agreement for <br />payment. The permittee shall maintain a $2,000.00 balance in an escrow account with the <br />City. This escrow shall be used to reimburse the City for expenses incurred in the <br />administration of this permit in the event the permittee fails to pay the City expenses within <br />the fifteen day billing period. The City reserves the right to use these funds to pay for <br />testing services as necessary. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Glen Hardin <br />Councilmember Kenneth Peterson <br />Councilmember Sheila Beyer <br />Councilmember Gerald Zimmerman <br />Councilmember Carolyn Beahen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br /> <br />
