Charier Commissioner Swokowski introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #96-02-032 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT //0392 TO RESPOND TO CITY <br />COUNCIL INQUIRY REGARDING CHAPTER 8 OF THE RAMSEY CITY <br />CHARTER <br /> <br /> WHEREAS, on October 24, 1995, the Ramsey City Council directed the Charter <br />Commission to review whether it is warranted to amend Chapter 8 of the City Charter to restrict <br />City Council from ordering a local improvement project unless the favorable petition received was <br />signed by more than 50% of the benefitting property owners. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CHARTER COMMISSION OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />That the Charter Commission met on November 30, 1995, and reviewed the current <br />requirements of City Charter Chapter 8. <br /> <br />That the Charter Commission determined that 50/50 is the most equitable equation that can <br />be achieved. <br /> <br />That the Charter Commission reflected that the City Council is charged with making <br />decisions in the best interest of the City. <br /> <br />That the Charter Commission determined that it is appropriately within the Council's realm <br />to be the decision maker or tie breaker when there is a 50/50 petition for a public <br />improvement project. <br /> <br />o <br /> <br />That the Charter Commission determined that the current process for ordering public <br />improvement projects is more rigorous than State Statute and to make it more so could <br />create problems and raise barriers. <br /> <br />That the Charter Commission determined that there had not been a sufficient number of <br />reports of problems with the current process to warrant amending Chapter 8. <br /> <br />That the Charter Commission determined that the current 50/50 process most nearly <br />emulates democracy in action. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Charter <br />Commissioner Kiefer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Steffen <br />Commissioner Swokowski <br />Commissioner Kiefer <br />Commissioner Donovan <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
