Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION g96-02-040 RESOLUTION AUTHORIZING THE AWARD FOR THE ACQUISITION OF WELSH PROPERTY FOR DRAINAGE PURPOSES WHEREAS, the City has initiated its public Improvement Project' g95-12 (the "Improvement Project") which project consists of constructing drainage improvements in a portion of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 and part of the Southeast Quarter of the Southwest Quarter, Section 15, Township 32, Range 25, Anoka County, Minnesota; and WHEREAS, a perpetual drainage easement over, under and across certain real property are required to provide for the construction of the Improvement Project and in order to further the public health, safety and convenience of the residents of the City; and WHEREAS, the City has authority to acquire the easements for the Public Improvement by eminent domain pursuant to Minnesota Statutes Chapter 117; and WHEREAS, the City has the right to acquire the easements prior to the filing of an award by the Court appointed commissioners, pursuant to Minnesota Statutes §117.011 and §117.042; and WHEREAS, certain of the property owners of the parcels of real property which are affected by the easements to be acquired have been identified in City Resolutions g95-09-211 and g95-11-253; and WHEREAS, pursuant to Resolution g95-11-253, the City Administrator was directed to acquire easements, including the following property, in accordance with Minnesota Statutes, and to negotiate and represent the City of Ramsey in all proceedings. FEE OWNER REAL PROPERTY DESCRIPTION Stanley E. Welsh and Leona E. Welsh husband and wife as joint tenants Parcels llA and liB CITY OF RAMSEY EASEMENT PLAT NO. 1 AND The Easterly 650 feet of the North Half of the North Half of the North Half of the Southwest Quarter of Northwest Quarter of Section 22, Township 32, North, Range 25 West, Anoka County, Minnesota. WHEREAS, the easement has not been able to be acquired by direct negotiation; and WHEREAS, the City Council authorized acquisition of the said easements by eminent domain and to take tire and possession of that land prior to filing of an award by the Court Appointed Commissioners pursuant to Minnesota Statutes §117.011 and § 117.042; and WHEREAS, an appraisal has been received valuing the subject property at $1,125. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows:
