Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g96-02-040 <br /> <br />RESOLUTION AUTHORIZING THE AWARD FOR THE ACQUISITION OF <br />WELSH PROPERTY FOR DRAINAGE PURPOSES <br /> <br /> WHEREAS, the City has initiated its public Improvement Project' g95-12 (the <br />"Improvement Project") which project consists of constructing drainage improvements in a portion <br />of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 and part of the <br />Southeast Quarter of the Southwest Quarter, Section 15, Township 32, Range 25, Anoka County, <br />Minnesota; and <br /> <br /> WHEREAS, a perpetual drainage easement over, under and across certain real property <br />are required to provide for the construction of the Improvement Project and in order to further the <br />public health, safety and convenience of the residents of the City; and <br /> <br /> WHEREAS, the City has authority to acquire the easements for the Public Improvement <br />by eminent domain pursuant to Minnesota Statutes Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the easements prior to the filing of an award <br />by the Court appointed commissioners, pursuant to Minnesota Statutes §117.011 and §117.042; <br />and <br /> <br /> WHEREAS, certain of the property owners of the parcels of real property which are <br />affected by the easements to be acquired have been identified in City Resolutions g95-09-211 and <br />g95-11-253; and <br /> <br /> WHEREAS, pursuant to Resolution g95-11-253, the City Administrator was directed to <br />acquire easements, including the following property, in accordance with Minnesota Statutes, and to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />FEE OWNER <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />Stanley E. Welsh and <br />Leona E. Welsh <br />husband and wife as <br />joint tenants <br /> <br />Parcels llA and liB <br />CITY OF RAMSEY EASEMENT PLAT NO. 1 <br />AND <br />The Easterly 650 feet of the North Half of the <br />North Half of the North Half of the Southwest <br />Quarter of Northwest Quarter of Section 22, <br />Township 32, North, Range 25 West, Anoka <br />County, Minnesota. <br /> <br />WHEREAS, the easement has not been able to be acquired by direct negotiation; and <br /> <br /> WHEREAS, the City Council authorized acquisition of the said easements by eminent <br />domain and to take tire and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes §117.011 and § 117.042; and <br /> <br />WHEREAS, an appraisal has been received valuing the subject property at $1,125. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br />
