Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-04-068 <br /> <br />RESOLUTION APPROVING ABATEMENT OF A SPECIAL ASSESSMENT TO <br />PIN R26-32-25-43-0048 FOR DELINQUENT UTILITIES CERTIFIED IN 1995 <br />FOR PAYABLE 1996 <br /> <br /> WHEREAS, the Finance Office has confu'med that delinquent utilities existed on PIN <br />R26-32-25-43-0048; and <br /> <br /> WHEREAS, it has been determined that these delinquent utilities were incurred by the <br />builder of the home and have existed since December 1993; and <br /> <br /> WHEREAS, a certified search for existing or pending special assessments was performed <br />for the Title Company by the City of Ramsey; and <br /> <br /> WHEREAS, it is not required for Title Companies to request the status of utilities at the <br />time of closing; and <br /> <br /> WHEREAS, at that point in time the City did not exercise its option to certify delinquent <br />utilities, therefore, the delinquent utilities were not reported on the certified search; and <br /> <br />WHEREAS, the builder has since ceased doing business and filed bankruptcy; and <br /> <br /> WHEREAS, the City was not notified of this bankruptcy and was unable to file a claim <br />for the delinquent utilities; and <br /> <br /> WHEREAS, it has been determined that the current homeowners have consistently been <br />timely on utility payments and should not be held responsible for this delinquency. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That the City Council hereby approves the abatement of $148.21 of special assessments for <br />delinquent utilities on PIN R26-32-25-43-0048. <br /> <br />2) <br /> <br />That the City Council hereby instructs the Finance Officer to process all paperwork as <br />required by Anoka County Auditors Office in this regard and to notify the property owner <br />of the Council's action. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon being taken thereon, the following voted in favor: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br /> <br />
