14. <br /> <br />The permit holder shall f'fle with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do business <br />in the State of Minnesota. <br /> <br />a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br /> person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of 10 <br />days prior notice to the City by registered mail of termination, cancellation or amendment of <br />the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this item <br />is obtained and fried with the City prior to the termination of the policy in force. <br /> <br />15. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by the <br />Minnesota Pollution Control Agency and the Environmental Protection Agency of the United <br />States. <br /> <br />16. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred <br />Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to <br />reimburse the City for expenses incurred in the administration of this permit. At the time the <br />mining operation and site restoration are completed to the satisfaction of the City, the balance of <br />the escrow shall be returned to the Permit Holder. <br /> <br />17. <br /> <br />All grading operations shall be conducted between 7:00 a.m. and 8 p.m. on weekdays only <br />unless otherwise specifically approved by the City Administrator and/or hi.s designee. <br /> <br />18. <br /> <br />The amount of dust or other particulate matter caused by the mining operation shall not exceed <br />the standards established by the Minnesota Pollution Control Agency. No operation shall be <br />allowed when wind gust exceed 30 miles per hour. <br /> <br />19. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency regulations <br />and Federal and Environmental Protection Agency regulations for the protection of water <br />quality. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Councilmember Gerald Zimmerman <br />Councilmember Kenneth Peterson <br />Councilmember Sheila Beyer <br />Councilmember Carolyn Beahen <br /> <br />and the following voted against the same <br /> <br />None <br /> <br />and the following abstained <br /> <br />Mayor Glen Hardin <br /> <br /> <br />
