Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-04-095 <br /> <br />RESOLUTION TERMINATING IMPROVEMENT PROJECT <br />(BITUMINOUS PAVING OF 151ST AVENUE, 152ND AVENUE <br />FLUORINE STREET WEST OF T.H. #47 IN SECTION 24) <br /> <br />#95-20 <br /> AND <br /> <br /> WHEREAS, on December 12, 1995, the City Council received a petition and ordered a <br />feasibility study to consider the improvement of bituminous paving of 151st Avenue, 152nd <br />Avenue, 152nd Avenue and Fluorine Street west of T.H. #47 in Section 24 (Improvement Project <br />g95-20); and <br /> <br /> WHEREAS, on January 9, 1996, the feasibility report was received by the Ramsey City <br />Council; and <br /> <br /> WHEREAS, ten days mailed notice and two weeks published notice of the public hearing <br />was given, and the public hearing was held on the 13th day of February, 1996, at which time all <br />persons desiring to be heard were given an opportunity to be heard thereon; and <br /> <br /> WHEREAS, on February 16, 1996, the City received a petition opposing Improvement <br />Project g95-20; and <br /> <br /> WHEREAS, the City Administrator has found the petition to be 52 percent of lawful <br />signatures of affected property owners, and to be in accordance with the City Charter and <br />Minnesota Statutes concerning local improvements; and <br /> <br />WHEREAS, the required sixty (60) days has elapsed following the public hearing. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That Improvement Project g95-20 (Bituminous Paving of 151st Avenue, 152nd Avenue, <br />152nd Avenue and Fluorine Street west of T.H. #47 in Section 24) is hereby terminated as <br />proposed in the Council resolution adopted December 12, 1995. <br /> <br />2) <br /> <br />That Improvement Project g95-20 may not be considered for a period of one year from the <br />13th day of February, 1996, as stated in Chapter 8 of the Ramsey City Charter. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Hardin <br />Councilmember Zimmerman <br />Councilmember Beyer <br />Councilmember Beahen <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
