Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> RESOLUTION #96-05-117 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0399 TO REZONE CERTAIN <br />PROPERTY FROM B-1 BUSINESS TO R-1 RURAL RESIDENTIAL <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey City Code; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Ann C. Moroz, hereinafter referred to as "Applicant", has properly applied to rezone <br /> certain property from B-1 Business to R-1 Rural Residential. <br /> <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br /> the City Code on May 7, 1996 and that said public hearing was properly advertised and that <br /> the minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br /> Lots 6 and 7, Block 1, Golden Eagle Estates, Anoka County, Minnesota <br /> <br /> ("the Subject Property"). <br /> <br />4. That the total area of the Subject Property to be rezoned is approximately 2.5 acres in size. <br /> <br />5. That the Subject Property is surrounded by parcels that are zoned R- 1 Rural Residential. <br /> <br />6. That the Subject Property has been zoned for commercial use since it was platted in 1972 <br /> and no commercial development has occurred on the property. <br /> <br />7. That the Applicant has stated that history bears out that there is not a demand for <br /> commercial uses in the area of the Subject Property and a rezoning to R-1 Rural Residential <br /> will allow a reasonable use of the property. <br /> <br />8. That the Applicant has received an offer for purchase of Lot 7 as a site location for the <br /> development of a single family dwelling unit. <br /> <br />9. That the proposed zoning amendment ill not substantially adversely impair the use or <br /> market value of any surrounding property. <br /> <br /> 10. That the proposed zoning amendment will not change the essential character of the area. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Perterson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Glen Hardin <br />Councilmember Sheila Beyer <br />Councilmember Kenneth Peterson <br />Councilmember Gerald Zimmerman <br />Councilmember Carolyn Beahen <br /> <br /> <br />
