Councilmember. introduced the following resolution and moved for its adoption: <br /> RESOLUTION#96-05 <br /> A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br /> REQUEST VOR A CONDITIONAL USE PERMIT FOR A GROUP FOSTER HOME. <br /> WHEREAS, on February 7, 1995,Patrick 1. McLafferty, hereinafter referred to as <br /> "Applicant",:applied for a Conditional Use Permit for a Group Foster Home on the <br /> property generally known as 7321 154th Lane N.W. and legally described as follows: <br /> The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of <br /> the SoutheastQuarter of the Northeast Quarter of Section 21, Township 32, Range 25 in <br /> ' Anoka County,Minnesota; said distances being measured parallel with the East and North <br /> lines of said Southeast Quarter of the Northeast Quarter, subject to an easement for road <br /> purposes over the South 33 feet thereof, and <br /> WHEREAS, on April 25, 1995, the Ramsey City Council adopted Resolution #95- <br /> 04-076 declaring Findings of Fact #0375 and denied the application for a conditional use <br /> permit; and <br /> ' WHEREAS, the Applicant filed an appeal with the courts; and <br /> WHEREAS, the Anoka County District Court has ordered the City to conduct a <br /> second public hearing and reconsider the request for a conditional use permit. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> ' CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. That on March 15, 1996, the District Court, Anoka County, Minnesota, issued an <br /> order directing the City to reconsider the Applicant's application for a conditional <br /> use permit and, in arriving at a decision to grant or deny such application, shall <br /> make 'appropriate and detailed findings regarding the basis for its decision as <br /> prescribed by Ramsey Zoning Ordinance, Section 9.03.04. <br /> ' 2. That the Applicant appeared before the Planning and Zoning Commission for a <br /> second public hearing pursuant to Section 9.03.04 (Conditional Use Permits) of the <br /> Ramsey City Code on May 7, 1996, exited the Council Chambers while the hearing <br /> was iri progress, and returned to Council Chambers prior to adjournment. Said <br /> I public hearing was properly advertised and the minutes of said public hearing are <br /> fhereby incorporated as a part of these findings by reference. <br /> 3. That the subject property is approximately one acre in size. <br /> 1 4. That the subject property is zoned R-1 Rural Residential and is not served by <br /> sanitary sewer and municipal water. <br /> ' 5. That the City utilizes State Statute 462.357 (Subd. 7 and 8) as a guideline and <br /> allows state licensed residential facilities accommodating up to six (6) youth in the <br /> single family residential districts as a permitted use and facilities accommodating <br /> ' more than six (6) youth are recommended for operation in higher density housing <br /> districts. <br /> �1 <br />
