Councilmember. introduced the following resolution and moved for its adoption: RESOLUTION#96-05 A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST VOR A CONDITIONAL USE PERMIT FOR A GROUP FOSTER HOME. WHEREAS, on February 7, 1995,Patrick 1. McLafferty, hereinafter referred to as "Applicant",:applied for a Conditional Use Permit for a Group Foster Home on the property generally known as 7321 154th Lane N.W. and legally described as follows: The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the SoutheastQuarter of the Northeast Quarter of Section 21, Township 32, Range 25 in ' Anoka County,Minnesota; said distances being measured parallel with the East and North lines of said Southeast Quarter of the Northeast Quarter, subject to an easement for road purposes over the South 33 feet thereof, and WHEREAS, on April 25, 1995, the Ramsey City Council adopted Resolution #95- 04-076 declaring Findings of Fact #0375 and denied the application for a conditional use permit; and ' WHEREAS, the Applicant filed an appeal with the courts; and WHEREAS, the Anoka County District Court has ordered the City to conduct a second public hearing and reconsider the request for a conditional use permit. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE ' CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That on March 15, 1996, the District Court, Anoka County, Minnesota, issued an order directing the City to reconsider the Applicant's application for a conditional use permit and, in arriving at a decision to grant or deny such application, shall make 'appropriate and detailed findings regarding the basis for its decision as prescribed by Ramsey Zoning Ordinance, Section 9.03.04. ' 2. That the Applicant appeared before the Planning and Zoning Commission for a second public hearing pursuant to Section 9.03.04 (Conditional Use Permits) of the Ramsey City Code on May 7, 1996, exited the Council Chambers while the hearing was iri progress, and returned to Council Chambers prior to adjournment. Said I public hearing was properly advertised and the minutes of said public hearing are fhereby incorporated as a part of these findings by reference. 3. That the subject property is approximately one acre in size. 1 4. That the subject property is zoned R-1 Rural Residential and is not served by sanitary sewer and municipal water. ' 5. That the City utilizes State Statute 462.357 (Subd. 7 and 8) as a guideline and allows state licensed residential facilities accommodating up to six (6) youth in the single family residential districts as a permitted use and facilities accommodating ' more than six (6) youth are recommended for operation in higher density housing districts. �1
