Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-06-138, <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, L.A.N.D. Properties has properly applied for a variance from the <br />impervious surface area restrictions in the Critical River Overlay District on the property <br />legally described as follows: <br /> <br />Lot 1, Block 1, RIVERVIEW ESTATES, Anoka County, State of Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on June 4, 1996, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from impervious <br />surface area restrictions. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA <br />OF MINNESOTA, as follows <br /> <br />THE BOARD OF <br />COUNTY, STATE <br /> <br />Based on Findings of Fact #0402, a variance to the impervious surface area <br />restriction is hereby granted. <br /> <br />The retail center shall be allowed for development on the Subject Property with an <br />impervious surface area limit not to exceed 77% of the tot area. Impervious <br />surfaces shall include all structures and surfaced driveways and parking areas. <br /> <br />The property owner shall manage all storm water runoff on and for the Subject <br />Property in accordance with the specifications and standards of the Department of <br />Natural Resources and the Lower Rum River Water Management Organization. <br /> <br />The property owner shall obtain ail necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey without certification of the variance by the Department of Natural <br />Resources in accordance ..with procedures established Section 9.21.07 (Critical <br />River Overlay District Development Standards) of the Ramsey City Code. <br /> <br />The property owner shall be responsible for all City costs incurred in administering <br />and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member Terry and upon vote being taken thereon, the following voted in favor thereof.' <br /> <br />Chairperson Benjamin Deemer <br />Board Member David Bawden <br />Board Member Charles LaDue <br />Board Member Paul Holland <br />Board Member Michael Terry <br />Board Member Sharon Jensen <br />Board Member Bradley Thorud <br /> <br /> <br />
