Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 96-06-147 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT BASED ON FINDINGS OF FACT 0403 AND DECLARING TERMS OF <br />PERMIT TO GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 96-06-146 adopting Findings <br />of Fact g0403 for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On June 11, 1996, a Conditional Use Permit' ("CUP") was issued by the City of Ramsey ("City") to <br />Edson Investment Family Limited Partnership ("Permit Holder") for grading operations on the <br />property legally described as follows: <br /> <br />BRANDSETH, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire one year from the commencement of operations and the Permit Holder <br />shall be responsible for providing the City with at least 48 hours advance notice of the date of <br />commencement of operations. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated December <br />20, 1995, prepared by Hakanson Anderson Associates, Inc., subject to the City Staff Review <br />Letter dated March 19, 1996. The proposed area tobe graded is roughly twenty-two (22) acres <br />in size. Excavation of the entire area shall be permitted. Continuation of grading shall require <br />finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored <br />mulch. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in such <br />a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed <br />from the worksite regularly. <br /> <br />The ingress and egress to the Subject Property shall be from one (1) location on 153rd Avenue <br />N.W., within the boundaries of Outlot A, Brandseth. The Permit Holder shall provide a 75 <br />foot long gravel approach at the access point onto 153rd Avenue N.W. to minimize the tracking <br />of grading materials from the site onto the public roadway. <br /> <br />Ail worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br /> <br />6. Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br /> <br />
