Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #96-08-191 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0405 TO REZONE CERTAIN <br />PROPERTY FROM B-1 BUSINESS TO R-1 RURAL RESIDENTIAL <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey City Code; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That C. Thomas Austin, hereinafter referred to as "Applicant", has properly applied to <br />rezone certain property from B-1 Business to R-1 Rural Residential. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on August 6, 1996 and that said public heating was properly advertised and <br />that the minutes of said public heating are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />The easterly 158.00 feet of Government Lot 4, Section 19, Township 32, Range <br />25, Anoka County, Minnesota <br /> <br />("the Subject Property"). <br /> <br />4. That the total area of the Subject Property to be rezoned is approximately 4.7 acres in size. <br /> <br />o <br /> <br />That the adjacent parcels to the east and west and the parcels on the north side of T.H. gl0 <br />are zoned B-1 Business. <br /> <br />That the Subject Property is in the Critical River Corridor and there is a pre-existing <br />dwelling on the Subject Property that is not in conformance with the established structure <br />setbacks from the Mississippi River. <br /> <br />That the Applicant desires to demolish the existing dwelling and construct a new dwelling <br />on the Subject Property that will be in conformance with the regulations of the Mississippi <br />Critical River Corridor. <br /> <br />o <br /> <br />That the 1980 Comprehensive Plan indicates that the existing zoning on the property was <br />B-1 Business, that the existing use was residential, and that the proposed zoning map of <br />1990 should convert the Subject Property and the adjacent parcels to the east and west to R- <br />i Rural Residential. <br /> <br />That history bears out that there is not a demand for commercial uses in the area of the <br />Subject Property and a rezoning to R-1 Rural Residential will allow the continuance of a <br />reasonable use of the property. <br /> <br />10. <br /> <br />That the proposed zoning amendment will not substantially adversely impair the use or <br />market value of any surrounding property. <br /> <br />11. That the proposed zoning amendment will not change the essential character of the area. <br /> <br /> <br />
