Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #96-09-220 RESOLUTION APPROVING PARTIAL PAYMENT TO W. B. MILLER, INC. FOR IMPROVEMENT PROJECT #96-18 (MCKINLEY STREET WEST OF C.R. #57) WHEREAS, the City Council of the City of Ramsey approved this project on May 14, 1996; and WHEREAS, on May 28, 1996, the City Council of the City of Ramsey adopted Resolution #96-05-133, awarding the bid to W. B. Miller, Inc. for the construction of McKinley Street for a distance of 400 feet west of C.R. #57 (Improvement Project g96-18); and WHEREAS, previous payment has been made to W. B. Miller, Inc. in the amount of $26,791.38; and WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends partial payment to W. B. Miller, Inc. in the amount of $48,401.07. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to W. B. Miller, Inc. for the construction of McKinley Street for a distance of 400 feet west of C.R. #57 (Improvement Project #96-18) in the amount of $48,401.07. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of September, 1996. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beahen and upon vote being taken thereon, the following voted in favor thereof: Mayor Hardin Councilmember Peterson Councilmember Beahen Councilmember Zimmerman and the following voted against the same: None and the following abstained: None and the following were absent: Councilmember Beyer
