Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION #96-09-272 <br /> <br />A'RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL <br />USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF A <br />PERSONAL COMMUNICATION SERVICE (PCS) TOWER AND <br />DECLARING TERMS OF SAME <br /> <br /> WHEREAS, AMERICAN PORTABLE TELECOM (APT) has properly applied <br />for a conditional use permit to construct and operate a telecommunications tower on a 50' x <br />50' section (site) of the property legally described as follows: <br /> <br />Lot 1, Block 1, HY-10 RAMSEY, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on September 3 1996, conducted the <br />public heating and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0412, a conditional use permit for a 165 foot self- <br />supporting lattice tower and related equipment cabinets is hereby granted to APT, <br />hereinafter referred to as "Permit Holder". <br /> <br />This permit is perpetual in its duration so long as the terms imposed herein are <br />complied with. <br /> <br />o <br /> <br />The development of the Site shall be in accordance with the 5 sheet site plan <br />prepared by Fluor Daniel, Inc., dated August 8, 1996, and the written support <br />materials prepared by A. Keith Dyer of APT dated August 12, 1996. <br /> <br />Prior to the issuance of a building permit for the tower, the Permit Holder shall <br />supply the City with a certified statement of non-interference with radio, television, <br />etc., services enjoyed by other residential and non-residential properties in the area <br />and copies of any permits required by other regulatory agencies. <br /> <br />The Permit Holder shall provide the City with conf'u'mation that the tower structure <br />complies with Electronics Industry Association standards and approval by a <br />licensed structural engineer. <br /> <br />o <br /> <br />The tower shall not be artificially lighted and shall not display strobe lights unless <br />such lighting is required by the Federal Aviation Administration or another <br />regulatory agency with jurisdiction over communications towers. <br /> <br />o <br /> <br />The chain link security fence shall be installed and maintained in accordance with <br />the approved site plan to prevent unauthorized entry to the site. <br /> <br /> <br />
