Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION #96-10-280 RESOLUTION APPROVING 2ND PARTIAL PAYMENT TO VOLK SEWER & WATER, INC. FOR IMPROVEMENT PROJECT #96-17 (RETENTION POND, UTILITY, AND STREET IMPROVEMENTS FOR MCKINLEY STREET EAST) WHEREAS, City Council authorized the preparation of plans and specifcafions for the above referenced work by motion on January 23, 1996; and WHEREAS, on July 9, 1996, the Ramsey City Council adopted Resolution #96-07-166 awarding the bid to Volk Sewer & Water, Inc. for the retention pond, utility, and street improvements for McKinley Street East (Improvement Project #96-17); and WHEREAS, previous payment has been made to Volk Sewer & Water, Inc. in the amount of $115,883.01; and WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends partial payment to Volk Sewer & Water, Inc. in the amount of $54,056.41. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to Volk Sewer & Water, Inc. for the retention pond, utility, and street improvements for McKinley Street East (Improvement Project #96-17) in the amount of $54,056.41. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of October, 1996. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman and upon vote being taken thereon, the following voted in favor thereof: Mayor Hardin Councilmember Beahen Councilmember Zimmerman Councilmember Beyer Councilmember Peterson and the following voted against the same: None and the following abstained: None
