Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-10-288 <br /> <br />RESOLUTION APPROVING PARTIAL PAYMENT TO EDSON INVESTMENT <br />FAMILY LIMITED PARTNERSHIP FOR THE EXPENSES INCURRED WITH <br />THE EXTENSION OF SEWER AND WATERMAIN TO THE BRANDSETH <br />SUBDIVISION AND THE MUNICIPAL BUILDING/POLICE STATION <br /> <br /> WHEREAS, the City entered into a development agreement on May 24, 1996, with the <br />Edson Investment Family Limited Partnership; and <br /> <br /> WHEREAS, Section 9 of said agreement made the Developer responsible for the <br />installation of water and sewer utilities to the subdivision, and also from the subdivision to the <br />Municipal Building/Police Station; and <br /> <br /> WHEREAS, within said agreement, the City agreed to reimburse the Developer the costs <br />of said extension over and above the normal trunk charges due from the Developer; and <br /> <br />WHEREAS, the Developer has installed the necessary sewer and watermains; and <br /> <br /> WHEREAS, the costs of the extensions has been estimated to be $153,060.16 over the <br />normal trunk charges due from the Developer; and <br /> <br /> WHEREAS, said improvements are substantially complete, but not fully accepted at this <br />time and, therefore, no more than 95% of those funds should be released; and <br /> <br /> WHEREAS, City Engineer Steve Jankowski has inspected and recommends partial <br />payment to Edson Investment Family Limited Partnership in the amount of $145,407.15. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby authorizes partial payment to Edson Investment Family <br />Limited Partnership for the installation of sewer and water utilities to the Brandseth <br />Subdivision and to the Municipal Building/Police Station in accordance with said <br />agreement. <br /> <br />2) <br /> <br />That the City Council hereby accepts the project and authorizes the Mayor or City <br />Administrator to sign the release form for this payment. <br /> <br />3) <br /> <br />That the total amount of this payment is not included in resolutions approving payment of <br />bills for the month of October, 1996. <br /> <br />4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof.' <br /> <br />Mayor Hardin <br />Councilmember Beahen <br />Councilmember Zimmerman <br />Councilmember Beyer <br />Councilmember Peterson <br /> <br /> <br />
