Councilmember Peterson introduced the following resolution and moved for its adoption; <br /> <br />RESOLUTION #96-10-307 <br /> <br />RESOLUTION APPROVING ABATEMENT OF CERTAIN SPECIAL <br />ASSESSMENTS CERTIFIED IN 1995 FOR CITY IMPROVEMENT PROJECT <br />#95-10, COUNTY PROJECT #82431 AND RE-CERTIFYING ASSESSMENTS <br />DUE TO INCORRECT ORIGINAL ASSESSMENT <br /> <br /> WHEREAS, Resolution //95-09-229 adopted the original assessment roll related to <br />Project//95-10 described as bituminous overlay of Countryside Estates; and <br /> <br /> WHEREAS, PINs 05-32-25-32-0020 and 05-32-25-32-0012 were assessed $483.41 <br />each in conjunction with Project g95-10; and <br /> <br /> WHEREAS, the above PINs lie adjacent to Sorteberg's 6th Addition which received <br />sealcoat and crack filling with Project g95-08 and would have been assessed $196.22 per unit if a <br />portion of the costs had not been offset by developer escrows; and <br /> <br /> WHEREAS, approximately two-thirds of the street frontage on the above PINs received <br />sealcoat and crack fill in lieu of the intended overlay; and <br /> <br /> WHEREAS, it is appropriate to abate the assessments related to a full overlay on all <br />frontages; and <br /> <br /> WHEREAS, a recalculated assessment of $120.57 be placed back on the County records <br />and spread over the terms applied to Project g95-08. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby approves the abatement of special assessments for Project <br />g95-10, County Fund #82431 for PINs 05-32-25-32-0020 and 05-32-25-32-0012. <br /> <br />2) <br /> <br />That such re-assessment, a copy of which is attached hereto and made a part hereof, is <br />hereby accepted and shall constitute the special assessment against the properties named <br />herein, and each tract of land therein included is hereby found to have benefited from the <br />original improvement in the amount of the assessment being levied against it. <br /> <br />3) <br /> <br />That such assessment shall be payable in annual installments extending over a period of <br />three years, the first installment to be payable with the first tax rolls of 1997, and shall bear <br />interest at 10.75%, the rate as originally certified. <br /> <br />4) <br /> <br />The owner of any property so assessed may, at any time, pay the whole of the assessment <br />on such property to the City Finance Officer, with interest accrued to December 31 of the <br />year in which payment is made. Such payment must be made before November 7 or <br />interest will be charged through December 31 of the next succeeding year. <br /> <br />5) <br /> <br />That the City of Ramsey hereby instructs the Finance Officer to process all paperwork as <br />required by the Anoka County Auditors Office in regard to the abatement and re- <br />certification and to notify the property owners involved of the Council's action <br /> <br /> <br />
