Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-10-309 <br /> <br />RESOLUTION AUTHORIZING <br />SEPTIC SYSTEM AT 17745 <br />RAMSEY, MINNESOTA <br /> <br />THE CITY OF RAMSEY TO REPAIR THE <br /> NOWTHEN BOULEVARD NORTHWEST, <br /> <br /> WHEREAS, after receiving a complaint, the City inspected the above property and <br />observed effluent running down the ditch on August 22, 1996; and <br /> <br /> WHEREAS, the City informed the property owner that the septic system is in failure and <br />a threat to public health on August 28, 1996; and <br /> <br /> WHEREAS, the property owner informed the City on September 4, 1996 that bids to <br />repair the system were being taken; and <br /> <br /> WHEREAS, after receiving no further correspondence from the property owner, the City <br />sent a letter to the owner on September 24, 1996 requesting verification that the owner had secured <br />a contractor to perform the repairs; and <br /> <br /> WHEREAS, after receiving no verification from the property owner of a secured bid, the <br />City was granted by the property owner on October 9, 1996 a request to enter the property to <br />perform a site evaluation which will include the construction of a complying system in the event <br />that the owner does not construct a complying septic system. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby authorizes the City's Building Official to perform a septic <br />system site evaluation at 17745 Nowthen Boulevard Northwest, Ramsey, Minnesota. This <br />evaluation will include a design for construction of a complying system. <br /> <br />2) <br /> <br />That the City Council hereby authorizes the City to construct a complying septic system at <br />said address in the event that the owner of the property fails to construct a complying septic <br />system. <br /> <br />3) <br /> <br />That the City Council hereby authorizes the City to include a new well with the septic <br />system if it is determined that this is necessary. This situation is being reviewed at this <br />time. <br /> <br />4) <br /> <br />That the costs of the above shall be assessed against the property in accordance with the <br />septic system repair policy. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Hardin <br />Councilmember Peterson <br />Councilmember Beahen <br />Councilmember Beyer <br />Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br /> <br />
