, .o Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g96-11-317 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, James and Michele Myslicki (Permittees) have properly applied for a <br />variance to construct an accessory structure nearer the front property line than the principal <br />structure on the property generally known as 16811 Zirconium Street N.W. and legally described <br />as follows: <br /> <br />The North Half of the South Half of the East Half of the Northeast Quarter of the Southeast <br />Quarter of Section 10, Township 32, Range 25, Anoka County, Minnesota; subject to the <br />road easement over the west 33 feet thereof. <br /> <br /> WHEREAS, the Board of Adjustment conducted a public hearing on November 7, 1996, <br />pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact g0413, a variance to construct an accessory structure nearer the <br />front property line than the principal structure on the Subject Property is hereby granted. <br /> <br />The accessory garage constructed on the subject property shall not be located any closer <br />than ninety (90) feet from the front property line. <br /> <br />o <br /> <br />That the Permittee shall obtain all necessary permits prior to commencing any construction <br />of the accessory structure. <br /> <br />That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure. <br /> <br />o <br /> <br />That the Permittee and/or property owner shall be responsible for all City costs incurred in <br />administering and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Terry and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Benjamin Deemer <br />Commissioner Michael Terry <br />Commissioner David Bawden <br />Commissioner Sharon Jensen <br />Commissioner Bradley Thorud <br />Commissioner Charles LaDue <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Commissioner Paul Holland <br /> <br /> <br />
