Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-11-330 <br /> <br />RESOLUTION DECLARING TERMS OF COMPLIANCE WITH CONDITIONS <br />RELEASING A TEMPORARY DRAINAGE EASEMENT ON LOT 1, BLOCK 5 OF <br />RUM ACRES ESTATES <br /> <br />WHEREAS, an easement for drainage exists over Lot 1, Block 5, Rum Acres Estates, <br />exists until sufficient storm sewer facilities eliminate the necessity of the easement; and <br /> <br />WHEREAS, storm sewer has been placed prodding an outlet for drainage from said lot; <br /> <br />and <br /> <br /> WHEREAS, additional drainage easements and storm water improvements would further <br />eliminate the necessity of the existing drainage easement over said lot; and <br /> <br /> WHEREAS, an agreement has been drafted identifying necessary conditions for the <br />release of the temporary drainage easement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the temporary drainage easement be released upon receipt of an executed copy of the <br />Easement Release Agreement by the City Administrator. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Hardin <br />Councilmember Zimmerman <br />Councilmember Beahen <br />Councilmember Beyer <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the 26th day of November, 1996. <br /> <br />Mayor <br /> <br />ATTEST: <br /> <br />'Cig) Administrator <br /> <br /> <br />
