Councilmember Zimmerman in~oduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g97-02-046 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR WATER <br />WELL AND WATER STORAGE PURPOSES <br /> <br /> WHEREAS, the City finds it necessary to add capacity to its existing municipal water <br />utility system; and <br /> <br /> WHEREAS, a new water well and well house (collectively the "Public Improvement") is <br />necessary to accomplish this additional capacity requirement; and <br /> <br /> WHEREAS, the City finds it necessary to acquire fee title to certain real property in order <br />to provide property for the construction of the water well and well house; and <br /> <br /> WHEREAS, the City has the right to acquire the real property for the Public Improvement <br />by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to filing of an award <br />by the Court Appointed Commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREAS, the property owner of the real property which needs to be acquired has been <br />identified by the City as follows: <br /> <br />PIN FEE OWNER <br /> <br />Part of The Menkveld Co. <br />28-32-25-11-0006 <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />The South 100.00 feet of the West 100.00 <br />of the East 750.00 of the Northeast Quarter <br />of the Northeast Quarter of Section 28, <br />Township 32, Range 25, Anoka County, <br />Minnesota. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it shall <br />be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Council hereby authorizes acquisition of the said real property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />4) <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to prosecute <br />such action to a successful conclusion or until it is abandoned, dismissed or terminated by <br />the City or Court. <br /> <br /> <br />
