Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 97-03-059 <br /> <br />A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, BASED ON <br />FINDINGS OF FACT NO. 0418, FOR MINING OPERATIONS ON PIN NO. 29-32-25-11- <br />0009. <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 97-03-058 regarding <br />Findings of Fact No. 0418 for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On March 25, 1997, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") <br />to Sidney Nyhusmoen ("Permit Holder") for mining operations on the property legally described as <br />follows: <br /> <br />Lot 1, Block 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire on May 1, 2000. <br /> <br />o <br /> <br />o <br /> <br />All equipment used for mining operations shall be maintained and operated in such a manner <br />to minimize noise, dust, and vibrations adversely affecting surrounding properties. All <br />equipment shall be kept in good repair. Abandoned equipment and rubbish shall be removed <br />from the work site regularly. <br /> <br />All work sites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the work site. <br /> <br />Existing tree and ground cover shall be preserved to the extent feasible. <br /> <br />Mining operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />No mining operations shall occur at below an elevation of 6 feet above the elevation of the <br />water table on the work site. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br /> <br />
