Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-04-082 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY MCKINLEY STREET <br />NW AND UTILITY TRUNK LINES TO SERVE THE AEC ENERGY PARK <br /> <br /> WHEREAS, the City finds it necessary to extend its municipal water and sanitary system <br />to promote the development of the AEC Energy Park; and <br /> <br /> WHEREAS, new utility infrastructure and public roadways (collectively the "Public <br />Improvement") are necessary to accomplish this requirement; and <br /> <br /> WHEREAS, the City finds it necessary to acquire fee title to certain real property in <br />order to provide property for the construction of the water and sanitary sewer trunk lines and <br />public roadway; and <br /> <br /> WHEREAS, the City has the right to acquire the real property for the Public <br />Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to filing of an award <br />by the Court Appointed Commissioners, pursuant to Minn. Stats. § 117.011 and § 117.042; and <br /> <br /> WHEREAS, the property owner of the real property which needs to be acquired has been <br />identified by the City as follows: <br /> <br />PIN <br /> <br />Part of <br />27-32-25-21-0012 <br /> <br />FEE OWNER <br />L. W. Makens <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />Lot 1, AUDITOR'S SUBDIVISION 31, <br />according to the map or plat thereof on <br />record in the office of the County Recorder <br />in and for Anoka County, Minnesota, <br />except that part lying Southerly and <br />Easterly of the following described line: <br />commencing at a point on the East line of <br />said Lot 1,200 feet South of the Northeast <br />comer thereof; thence South 37 degrees 56 <br />minutes 28 seconds West, a distance of <br />283.98 feet to the South line of said Lot 1 <br />and there terminating. <br /> <br /> AND WHEREAS, the property owner has requested the City begin the condemnation <br />proceedings. <br /> <br /> <br />
