Board Member Holland introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-086 <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Peter and Linda Mayer (Permittees) have properly applied for a variance <br />from Section 9.11.02 of the Ramsey City Code to construct an accessory structure nearer the <br />front property line than the principal structure on the property generally known as 7190 175th <br />Avenue NW and legally described as follows: <br /> <br />The West 330.00 feet of the Southwest Quarter of the Southwest Quarter of Section 3, <br />Township 32, Range 25, Anoka County, Minnesota. Subject to 175th Avenue NW. <br />Subject to easements of record. <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on May 6, 1997, <br />pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact #0423, a variance to construct an accessory structure nearer <br /> the front property line than the principal structure on the Subject Property is hereby granted. <br /> <br />2. That the accessory garage constructed on the subject property shall not be located any closer <br /> than 85 feet from the centerline of the right-of-way of County Road #63 (175th Avenue NW). <br /> <br />3. That the Permittees shall obtain all necessary permits prior to commencing any construction <br /> of the accessory structure. <br /> <br />4. That the accessory structure shall be used for storage of personal property and that no <br /> commercial activity of any type shall be permitted in said structure. <br /> <br />5. That the Permittees and/or property owners shall be responsible for all City costs incurred in <br /> administering and enforcing this variance. <br /> <br />o <br /> <br />That the Permittees understand and agree that should County Road #63 be widened in the <br />future, there will be no claim for loss of property should it be necessary to remove any <br />building structure under this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Jensen, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
