Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-091 <br /> <br />RESOLUTION AUTHORIZING RELEASE OF COVENANT REGARDING USE OF <br />BISON STREET <br /> <br /> WHEREAS, by a Court Order and Stipulation dated June 4, 1982, the City agreed with <br />reference to Bison Street as follows: <br /> <br />"... contemporaneously with any relocation of the roadway, that it (City) shall <br />take the necessary legal proceedings to vacate the encroaching portion of the <br />roadway as a public road, said proceedings to be at no direct cost to Applicants, <br />and to effectuate a conveyance thereof to the Applicants." <br /> <br /> AND WHEREAS, the above provision is a memorial on the Certificate of Title of an <br />adjacent property; and <br /> <br /> WHEREAS, the adjacent property owner has requested that the City act to release its <br />interest in the adjacent property by an appropriate release document; and <br /> <br /> WHEREAS, the Anoka County Examiner of Titles Office has recommended the correct <br />language for the City to use in granting the release. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the City hereby authorizes its Mayor and City Administrator to execute on behalf of the <br /> City a Release containing the following language: <br /> <br />"The Registrar of Titles of Anoka County is accordingly authorized and directed <br />by the filing of this Release to omit from future Certificates of Title the recital of <br />the covenant regarding the use of Bison Street, as set forth in Stipulation dated <br />June 4, 1982 and filed June 16, 1982 in Torrens Case No. T-2562." <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Zimmerman <br />Councilmember Beyer <br />Councilmember Beahen <br /> <br />and the following voted against the same: <br /> <br /> <br />
