Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-126 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR A SEASONAL OUTDOOR RECREATIONAL FACILITY BASED UPON <br />FINDINGS OF FACT #0425 AND DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Holm's Super Bowl, Inc. (Permittee) has properly applied for a conditional <br />use permit (CUP) on the property generally known as 6720 Riverdale Drive NW and legally <br />described as follows: <br /> <br />Lot 1, Block 1, Riverview Bowl, Anoka County, Minnesota <br /> <br />(the subject property); and <br /> <br /> WHEREAS, the Planning Commission met on April 21, 1997, and conducted a public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY coUNcIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />Term: This permit shall be perpetual in its duration so long as the conditions imposed <br />herein are complied with. <br /> <br />2) <br /> <br />Site Development: The development and operation of the outdoor recreational facilities <br />shall be specifically limited to that described in the permittee's site plan and volley ball <br />court detail planconsisting of Sheets 1, 2 and 3 dated received by the City on April 3, <br />1997, and Sheet 4 received by the City on August 5, 1997. <br /> <br />3) <br /> <br />Off-Street Parking: The permittee shall provide sufficient off-street parking in <br />accordance with the standards established in the Ramsey City Code. Said parking shall <br />be implemented upon notice from the City if off-site parking becomes a regular <br />occurrence. <br /> <br />4) <br /> <br />Hours of Operation: All volleyball play and outdoor concession sales shall cease by <br />10:00 p.m. and the outdoor recreational area shall be cleared of all activity by 10:30 p.m. <br />This restriction shall also apply to any lighting used in this recreational area of the site. <br /> <br />5) <br /> <br />Restroom Facilities: The use of portable restroom facilities shall be screened from the <br />general public. <br /> <br />6) <br /> <br />Control of Operations: The permittee shall be responsible for enclosing the entire <br />outdoor recreational activity area in a chain link fence. This chain link fence is approved <br />for construction on the common property line with the adjacent parcel to the southwest of <br />the subject property. The permittee shall be responsible for maintaining a tree screening <br />between the subject property and the adjacent parcel to the southwest. It is herein agreed <br />that the volley ball courts will maintain a 40-foot setback from the common property line <br />with the adjacent parcel to the southwest. <br /> <br /> <br />
