Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-132 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF A PERMANENT EASEMENT FOR <br />CITY STREET AND UTILITY PURPOSES <br /> <br /> WHEREAS, the City finds it necessary to construct an extension of Llama Street south <br />of U.S. Highway 10 (the "Street Improvement Project"); and <br /> <br /> WHEREAS, a permanent easement over, under and across certain real property is <br />required to provide for the construction of the Street Improvement Project and in order to further <br />the public health, safety and convenience of the residents of the City; and <br /> <br /> WHEREAS, the City has authority to acquire a permanent easement for the Street <br />Improvement Project by eminent domain pursuant to the City Charter and Minn. Stat. Chapter <br />117; and <br /> <br /> WHEREAS, The City has the right to acquire the permanent easement prior to the filing <br />of an award by the Court approinted commissioners, pursuant to Minn. Stats. §117.011 and <br />§117.042; and <br /> <br /> WHEREAS, the property owner of the real property over which the permanent easement <br />needs to be acquired, upon information and belief, has been identified by the City as follows: <br /> <br />PIN FEE OWNER <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />29-32-25-13-0002 <br /> <br />Joseph H. Nathe <br /> <br />All that part of the West 2 rods and 6 feet of the <br />Southwest Quarter of Northeast Quarter of <br />Section 29, Township 32, Range 25 lying and <br />being south of Trunk Highway No. 10, formerly <br />known as U.S. Military Road <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire a permanent easement for street <br />and utility purposes over, under and across the real property as described above in <br />accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and <br />represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the permanent easement as described above cannot be acquired by direct <br />negotiation, it shall be acquired by eminent domain. <br /> <br /> <br />
