Councilmember Haas Steffen introduced the following resolution and moved for its adoption: RESOLUTION #97-05-140 RESOLUTION RECEIVING PETITION AND ORDERING IMPROVEMENT PROJECT/t97-19 (UTILITY AND STREET IMPROVEMENTS TO AZURITE STREET) WHEREAS, the City has received a petition by 100 percent of the affected property owners in favor of bituminous surfacing of Azurite Street from the northern boundary of Outlot A, Ferrum Addition (the limits of Improvement Project//96-23) to 141st Avenue NW; and WHEREAS, the City Administrator has found the petition to be in accordance with the City Charter and Minnesota Statutes concerning local improvements; and WHEREAS, modifications to the plans and specifications accommodating this project as an addition to Project//96-23, including the extension of sanitary sewer and watermain to the northern boundary of Outlot A of the Ferrum Addition, will be made by John Oliver and Associates; and WHEREAS, W.B. Miller, Inc. is currently under contract for similar work on the contiguous work site associated with Project #96-23; and WHEREAS, the work associated with Improvement Project #97-19 is less than 25% of the current contract amount with W.B. Miller, Inc., and therefore eligible for award by Change Order to the existing contract; and WHEREAS, a Change Order for the work associated with Improvement Project #97-19 has been prepared and accepted by W.B. Miller, Inc. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That a certain petition requesting consideration of the improvement of bituminous surfacing of Azurite Street from the northern boundary of Outlot A, Ferrum Addition (the limits of Improvement Project #96-23) to 141st Avenue NW has been filed with the City Council on May 19, 1997. The petition is hereby declared to be signed by 100% of the affected property owners. This declaration is made in conformity to City of Ramsey Code Section 4.60 and Minnesota Statute Chapter 429. 2) That Improvement Project #97-19 is hereby ordered by the City Council. 3) That City Engineer Steve Jankowski is hereby designated as the engineer for this improvement.
