Councilmember Haas Steffen introduced the following resolution and moved for its adoption: RESOLUTION #97-06-149 RESOLUTION EXTENDING THE TERM OF ORDINANCE #97-03, WHICH ORDINANCE PLACED A MORATORIUM ON THE SUBDIVIDING OF CERTAIN LAND WITHIN THE CITY OF RAMSEY WHEREAS, on April 8, 1997, the City Council adopted Ordinance #97-03, which is an interim ordinance establishing a moratorium on the subdividing of land within a part of the City (the "Ordinance"); and WHEREAS, the Ordinance provides that it shall expire on June 11, 1997; and WHEREAS, the Ordinance, Section 7, provides that the City Council may extend its term for additional periods not to exceed 29 months; and WHEREAS, the City Council finds that the purposes of the Ordinance still exist and are valid and the studies ordered pursuant to the Ordinance have not bee completed; and WHEREAS, the City Council finds that the proposed Apple Ridge Plat as modified is within the MUSA; and WHEREAS, application for the proposed Apple Ridge Plat was made prior to adoption of Ordinance #97-03; and WHEREAS, the City Council finds that an extension of the term of the Ordinance is necessary to complete the studies and in order to protect the planning process and the health, safety, and welfare of the citizens of Ramsey. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: 1) That the term of Ordinance #97-03 be extended such that it shall expire on July 14, 1997 AND that the proposed Apple Ridge Plat legally described as follows be excluded from the moratorium created by Ordinance #97-03: The south half of the Southeast Quarter of Section 14, Township 32, Range 25, Anoka County, Minnesota, lying west of the west right-of-way line of State Highway No. 47, EXCEPT the following: Commencing at the northwest comer of said south half of the Southeast Quarter of Section 14; thence with the south line of said south half North 89 degrees 45 minutes 41 seconds East, on an assumed bearing basis, 1327.72 feet to the point of beginning herein; thence continuing with said south line North 89 degrees 45 minutes 41 seconds East, 808.12 feet to the computed west right-of-way line of State Highway No. 47;
