Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION #9%07-168 RESOLUTION APPROVING 2ND PARTIAL PAYMENT TO W. B. MILLER, INC. FOR IMPROVEMENT PROJECTS #96-23 (MCKINLEY STREET TO COMMERCIAL ASPHALT) AND #97-19 (UTILITY AND STREET IMPROVEMENTS TO AZURITE STREET) WHEREAS, the Ramsey City Council approved Improvement Project #96-23 on July 23, 1996; and WHEREAS, on April 8, 1997, the Ramsey City Council adopted Resolution #97-04-070, awarding the bid to W. B. Miller, Inc. for the construction of McKinley Street to the Commercial Asphalt property (Improvement Project #96-23); and WHEREAS, on May 27, 1997, the Ramsey City Council adopted Resolution #97-05-140 awarding Improvement Project #97-19 to W.B. Miller, Inc. as a Change Order to Improvement Project #96-23; and WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends partial payment to W. B. Miller, Inc. in the amount of $81,644.32. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to W. B. Miller, Inc. for the construction of McKinley Street and Azurite Street (Improvement Projects #96-23 and #97-19) in the amount of $81,644.32. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of July 1997. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Beahen Councilmember Zimmerman
