Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-07-178 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0433 RELATING TO A REQUEST <br />FROM THOMAS KURAK FOR A CONDITIONAL USE PERMIT TO GRADE AND <br />EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from Thomas Kurak for a <br />conditional use permit to grade and export excess soils from the property legally described as <br />follows: - <br /> <br />The Southeast Quarter of the Southwest Quarter, Section 23, Township 32, Range 25, <br />Anoka County, Minnesota. Together with that part of Government Lot 1 of said Section <br />23 lying easterly of the easterly line of the fight-of-way of County Road No. 57, also <br />known as Sunfish Lake Boulevard, according to the duly recorded plat of ANOKA <br />COUNTY HIGHWAY RIGHT-OF-WAY PLAT NO. 1. Excepting from said <br />Government Lot 1 all that part thereof described as commencing at a point on the south <br />line of said Government Lot 1 a distance of 572.00 feet East of the southwest comer <br />thereof; thence North 15 degrees 51 minutes 08 seconds East for 741.00 feet to a point to <br />be hereafter known as Point "G" for the purposes of this description; thence South 89 <br />degrees 21 minutes 08 seconds West parallel with said south line of Government Lot 1 <br />for about 65.73 feet to intersect with the above described easterly line of fight-of-way of <br />County Road No. 57, said point of intersection also being the actual point of beginning of <br />the exception to be hereby described; thence return East to said Point "G"; thence South <br />26 degrees 38 minutes 52 seconds East for 366.00 feet; thence South 3 degrees 08 <br />minutes 52 seconds East for about 381.89 feet to intersect said south line of Government <br />Lot 1; thence South 89 degrees 21 minutes 08 seconds West along said south line of <br />Government Lot 1 for about 646.17 feet to intersect with the above described easterly line <br />of the right-of-way of County Road No. 57; thence northeasterly along said easterly line <br />of the right-of-way of County Road No. 57 for about 856.05 feet to the point of <br />beginning. For the purposes of this exception description, said south'line of Government <br />Lot 1 is assumed to bear North 89 degrees 21 minutes 08 seconds East. <br /> <br />(the "Subj ect Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on March 11, 1997, Thomas Kurak, hereinafter referred to as "Applicant", applied for <br />a conditional use permit to grade and export excess soils from the Subject Property. <br /> <br /> <br />
