10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />Prior to the removal of trees in any of the 11 phases, the City Engineer shall be notified at least <br />72 hours in advance of the removal so that the number of trees required for reforestation can be <br />detemfined. <br /> <br />A detailed analysis of the trees to be removed in Phases VII and XI shall be submitted to the <br />City Engineer prior to excavating within those areas. The proposed removal shall be <br />determined to be in compliance with the City's shoreland zoning ordinance, Section 9.21 of <br />Chapter 9 of the City Code. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />All haul roads to and from the Subject Property shall be maintained in order to minimize dust <br />and in a condition satisfactory to the City Engineer. This work shall include application of <br />water, bituminous material, or calcium chloride to the road surface as may be necessary to <br />alleviate dust nuisance and eliminate traffic hazards. This work shall also include daily <br />inspections of Sunfish Lake Blvd. and the removal of spillage of any materials from the <br />operation. When hauling operations are completed, the permit holder shall either restore that <br />haul road to a condition at least equal to that which existed at the time the hauling operations <br />were started, or compensate the local road authority in an amount satisfactory to that road <br />authority and concurred in by the City Engineer for the restoration of that haul road. The City <br />Engineer will then accept such restoration or concur in such financial settlement for the <br />restoration of the haul road in writing and such acceptance will relieve the permit holder of any <br />additional obligation in connection with the restoration of the haul roads. If the permit holder <br />fails or refuses to perform haul road restoration or to make satisfactory financial settlement for <br />such restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper than a <br />rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face be left <br />unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When mining <br />operations are anticipated to be discontinued for an interval greater than two working days, the <br />slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical. Final <br />slopes shall be consistent with the plan submitted and shall be no steeper than 12 feet <br />horizontal to 1 foot vertical. <br /> <br />Ingress and egress shall be along the designated haul roads identified on the Subject Property <br />to the access location specified on Sunfish Lake Blvd. Public haul roads beyond the Subject <br />Property shall be limited to State and County roadways. <br /> <br />RESOLUTION #97-07-179 <br /> Page 3 of 6 <br /> <br /> <br />
