Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-08-193 <br /> <br />RESOLUTION DECLARING SEPTIC SYSTEM FAILURE AT 5600 - 142ND AVENUE <br />NW AND EXERCISING TIlE CITY'S RIGHT TO CAUSE ITS REPAIR <br /> <br /> WHEREAS, the City has received a letter from Richard and Jeanine Whorton, owners <br />and residents of 5600 - 142nd Avenue NW, wherein they have presented testimony attesting to <br />the failure of the septic system at that address, and <br /> <br /> WHEREAS, the Whorton's have acknowledged their desire to rectify the public health <br />nuisance the failed system presents, but have been unable to secure funding to facilitate the <br />repair, and <br /> <br /> WHEREAS, the City has the authority under Section 8.30, sub. 4 of the City Code to <br />cause the repair of said failed systems and has adopted a policy for implementing this code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City Administrator is directed to cause the repair of said failed system. <br /> <br />2) <br /> <br />That the costs of the repair of said system be recovered pursuant to City Code 8.30.08, <br />sub. 5, and the City's current policy for Septic System Repair. ' <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen, and upon vote being taken thereon, the following voted in favor thereof. <br /> <br />Mayor Gamec <br />Councilmember Zimmerman <br />Councilmember Beahen <br />Councilmember Beyer <br />Councilmember Haas Steffen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br /> <br />
